Objectives / Authority

The Safe and Creative Media Development Fund Act B.E. 2558 (2015) defines the objectives and powers of the Fund as follows:

Article 5

A fund shall be established called the "Safe and Creative Media Development Fund." The fund shall be a legal entity with the following objectives:

(1) Campaign, promote and support the development of safe and creative media.
(2) Promote the development of the potential of producers of safe and creative media.
(3) Promote and support the public, especially children, youth and families, to have media literacy skills and to monitor unsafe and unconstructive media.
And they can use media to develop themselves, their communities, and society.
(4) Promote and support broad public participation in order to develop safe and creative media.
(5) Promote research, training, knowledge development and innovation in safe and creative media.
(6) Promote individuals, community organizations, private organizations, public benefit organizations, government agencies, state enterprises, or other government units that carry out activities related to media to produce and develop safe and creative media.
(7) Implement and promote safe and creative media that is accessible and usable by all.

Article 9

The Fund shall be empowered to carry out various activities within the scope of its objectives as set forth in Section 5, and such power shall include:

(1) Owning, possessing, and having various property rights.
(2) Establishing rights or performing any legal acts both within and outside the Kingdom.
(3) To profit from the fund's assets.
(4) Perform any other actions related to or connected with the objectives of the fund.

Article 21

The committee has the power and duty to oversee the fund to ensure that its operations are in accordance with the objectives set forth in Section 5. Such power and duty includes:

(1) Establish policies, plans and strategies regarding the development of safe and creative media.
(2) Issue a notice specifying the characteristics of unsafe and uncreative media.
(3) Establish measures to promote the development and skills in media literacy, as well as to promote the use of media as a tool for learning and developing oneself, the community, and society.
(4) Establish measures to promote public participation in media monitoring in accordance with Section 5 (3).
(5) Establish measures to strengthen cooperation and coordination between government agencies, state enterprises and other government entities, as well as the private sector, in developing safe and creative media.
(6) Approve the annual operating plan, financial plan and annual budget of the fund.
(7) Issue regulations on the criteria and methods for allocating funds to projects or activities related to the development of safe and creative media.
(8) Issue regulations concerning the division of internal departments of the office and the scope of duties of such departments.
(9) Issue regulations concerning the selection of managers, the operation and delegation of authority of managers.
(10) Issue regulations concerning the administration, personnel management, finance, supplies and assets of the Office and the internal audit of the Fund.
(11) Issue regulations concerning the determination of compensation rates or service fees for the operation of the fund.
(12) Determine the number, positions, employment periods, salary rates and wages of officers and employees.
(13) Appoint advisors, subcommittees on promoting public participation, subcommittees on monitoring unsafe and uncreative media, subcommittees on promoting and supporting innovation for the development of safe and creative media, and other subcommittees as deemed appropriate to consider or carry out tasks assigned by the Committee.
(14) Perform any other actions necessary to achieve the objectives of the fund.
The announcement under (2) and the regulations under (7) shall be published in the Government Gazette.

Article 23

A subcommittee for the administration of the Safe and Creative Media Development Fund shall be established, comprising:

The Permanent Secretary of the Ministry of Culture chairs the subcommittee. It includes representatives from the Ministry of Defence, the Ministry of Finance, and five experts appointed by the committee from among those with knowledge, skills, and experience in finance, law, social development or psychology, culture, and mass media (one person from each field). The manager serves as a subcommittee member and secretary.

Article 25

The office has the following powers and duties:

(1) Responsible for the administrative work of the Board, the Sub-Committee for the Administration of the Safe and Creative Media Development Fund, and the Sub-Committee under Section 21 (13).
(2) Propose policies, plans and strategies regarding the development of safe and creative media, annual operational plans, financial plans and annual budgets of the Fund, as well as study, analyze and evaluate the performance of the Fund to the Board.
(3) Provide advice to media producers on producing safe and creative media.
(4) Prepare the accounts and annual performance reports of the fund.
(5) Carry out any other tasks as assigned by the Board, the Sub-Committee for the Administration of the Safe and Creative Media Development Fund, and the Sub-Committee under Section 21 (13).
